Terms of Use

Welcome to used.kiwi. These Terms of Use ("Terms") set out the agreement between you and Insight AI Systems Limited (New Zealand) ("we", "us", "used.kiwi") when you use our website and services. By creating an account, listing an item, or making a purchase, you agree to these Terms.

1. Who we are and what used.kiwi is

used.kiwi is a New Zealand marketplace for genuine second-hand goods only. We connect real Kiwis buying and selling used items directly with one another. We are not a retailer and we do not sell our own stock.

2. No shops, no wholesalers, no new goods

used.kiwi is strictly for private, second-hand trading. The following are not permitted:

• New, retail, or imported-for-resale products.
• Drop-shippers, wholesalers, importers, or retail chains.
• Bulk commercial selling that amounts to running a shop.

We reserve the right to remove listings and suspend accounts that breach this principle.

3. The anti-corporate promise

used.kiwi is built to stay the Kiwi way. We will not turn used.kiwi into a retail channel for importers, drop-shippers, or chain stores. This commitment is written into how we operate.

4. Your account

You must be 18 or over to hold a standard account. You are responsible for keeping your login secure and for all activity under your account. You must provide accurate information and keep it up to date. Children may participate only through used.kiwi/kids under the supervision of an Authorised Person — see our How Kids works page.

5. Listings and selling

You must own the items you list and have the right to sell them. Listings must be honest, accurately describe condition, and use genuine photos of the actual item. Prohibited and restricted items are set out in our Community Guidelines.

6. Buying

When you buy, you enter into a contract directly with the seller. used.kiwi provides the platform but is not a party to the transaction. Inspect items where possible and follow our Safety Centre guidance.

7. Fees

Listing is currently free. If we introduce fees, we will give clear notice before they apply.

8. Conduct and enforcement

You agree not to misuse the platform, harass others, post unlawful content, or attempt to defraud anyone. We may warn, suspend, or permanently ban accounts that breach these Terms or our Community Guidelines.

9. Liability

To the extent permitted by law, used.kiwi is provided "as is". See our Disclaimer for the limits of our liability. Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded.

10. Privacy

We handle your personal information in line with our Privacy Policy and the Privacy Act 2020.

11. Changes

We may update these Terms from time to time. Material changes will be notified on the site. Continued use after changes means you accept the updated Terms.
